Terms and conditions of sale

Article 1

The present terms and conditions of sale govern the sale of the prints of Valérie Mazet d'Auria appearing on the present Internet website. They prevail over any other stipulation from the buyer. Each order implies the adhesion of the purchaser without restrictions nor reserves to the present terms and conditions of sale of the photographer Valérie Mazet d'Auria called hereafter the salesman. The purchasers placing an order are hereinafter referred to as the purchaser.


Article 2

The orders placed on this website engage the buyer as soon as he finalized the ordering process. Each work is described and accompanied by a catalog photo which is only indicative. The finalization of an order of art print or photographic print on the website implies the acceptance in full knowledge and without reserve of the price, the description of the work (format, support or material), the quantity of each work ordered. A difference of 8% in the format inherent to the constraints of a quality production is tolerated.


Article 3

The prices indicated are inclusive of all taxes. The works are subject to the VAT (Value Added Tax) in force in France on the day of the order. The payment of the acquisition is carried out cash at the time of the taking of the order by bank card (Carte Bleue, Visa, Eurocard, Mastercard) and the payment on the Internet site is protected by the service Paypal. The order is recorded and effective upon receipt of payment. The data recorded by the payment system constitutes proof of the financial transaction. Orders that are not paid for will not be delivered. Orders indicating delivery by post office box are not accepted. The works ordered are the property of the seller until effective receipt of payment.


Article 4

In accordance with the french Law "Informatique et Libertés", the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL), the customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification of data concerning him.  To exercise this right, he/she should send an e-mail indicating the fields or information that he/she wishes to modify via the contact form on the site.


Article 5

The information given by the buyer when placing an order must be complete, exact and precise; it is binding on the buyer: in the event of an error in the wording of the delivery details, the seller cannot be held responsible for non-delivery. Any customs duties are the responsibility of the buyer. The buyer must check the condition of the products upon receipt and immediately make any necessary reservations to the carrier. Delivery times, given as an indication, are approximately 3 weeks. These deadlines may be extended in case of exceptional periods (pandemic, natural disasters and any exceptional phenomenon hindering the smooth running of the usual processes). A delay can neither justify damages, nor be a reason for cancellation of the order. The goods travel at the risk of the recipient whatever the modalities of forwarding.


Article 6

Any complaint must be transmitted within 48 hours from the reception of the product which will be preserved in its original packing. The seller cannot be held responsible for a potential deterioration of the works due to their late withdrawal from the carrier or the logistics company.


Article 7

In accordance with the provisions of the legislation on distance selling, and in particular online sales via the internet, reinforced by the Hamon law of June 2014, the buyer has a right of withdrawal of 14 days from the delivery of the work. In this case, the work must imperatively be returned intact, in perfect condition for resale in its original packaging. Otherwise, all costs of restoring the work will be due by the buyer. Any work returned without prior information to the seller will not be taken in charge. The cost of returning the work is the responsibility of the buyer. The buyer will be reimbursed within 30 days from the reception by the seller of the returned work.


Article 8

In case of unavailability for any reason whatsoever of the delivery of one of the ordered works, the seller reserves the right to propose an equivalent or superior work in price, unless the buyer expressly indicates otherwise when ordering.


Article 9

The responsibility of the seller cannot be engaged in case of non-respect of the legislation of the country where the works are delivered. It is up to the customer to check with the local authorities the possibilities of importation or use of the works.


Article 10

Only the present terms and conditions of sale in French are authentic. For any dispute or contestation, whatever the nature or cause, the French courts will have exclusive jurisdiction.
